Collector Terms.

The terms that apply to you when buying through the POKISTOCK marketplace.

1. Who these terms apply to

These Collector Terms apply to anyone ("you", "Collector") who browses, orders, or purchases through the POKISTOCK marketplace, app, or website. By placing an order, you agree to be bound by these Terms, alongside our Privacy Policy.

2. What POKISTOCK is

POKISTOCK is a marketplace. We connect independent Vendors with Collectors and provide the platform, search, payment processing, and order tools that make buying and selling possible.

We are not the seller of the goods you buy. Each Vendor is an independent seller responsible for their own listings, descriptions, pricing, and stock. The contract of sale for each order is between you and the Vendor, not POKISTOCK.

3. Vendor responsibility (the default rule)

Unless Section 4 below applies, the Vendor you buy from is responsible for:

• The accuracy of their listing, including condition, edition, and authenticity;
• Packaging and dispatching your order using tracked, signed-for postage;
• Responding to questions, complaints, and disputes raised through POKISTOCK;
• Issuing returns, replacements, or refunds where something has gone wrong with your order.

If you have a problem with an order, contact the Vendor first through the order or support tools in the app. Most issues are resolved directly between Collector and Vendor.

4. When POKISTOCK will step in and refund you directly

There is one specific situation where POKISTOCK will refund you directly, rather than leaving this to the Vendor: where a Vendor has become unresponsive or inactive, and cannot be reached to resolve your order.

In that situation, POKISTOCK may, at its discretion, issue you a refund directly, and will take appropriate action against the Vendor’s account.

Outside of this specific situation, disputes, complaints, and refund requests are a matter between you and the Vendor, and POKISTOCK is not automatically responsible for resolving them, though we may assist in facilitating a resolution.

5. Placing an order

When you place an order, you are making an offer to buy at the listed price. A Vendor’s acceptance of payment completes the contract of sale between you and that Vendor.

Prices shown include POKISTOCK’s marketplace fee where applicable to the Vendor, and any postage charged by the Vendor is shown separately at checkout.

6. Payment

Payments are processed securely through our payment provider, Stripe. POKISTOCK does not see or store your full card details.

7. Delivery

Vendors are required to dispatch your order using tracked, signed-for postage, within the timeframe stated on their profile. You can view your order’s status at any time in your account.

8. Returns, refunds and your consumer rights

Nothing in these Terms affects your statutory consumer rights under UK law, including your rights in relation to faulty, misdescribed, or undelivered goods.

Returns and refunds are, by default, the Vendor’s responsibility (see Section 3), except in the specific situation described in Section 4.

9. Your conduct

When using POKISTOCK, you agree to:

• Provide accurate delivery and contact information;
• Pay promptly for any order you place;
• Communicate respectfully with Vendors and POKISTOCK support;
• Not attempt to circumvent POKISTOCK to transact with a Vendor outside the platform.

10. Disputes

If you have a dispute with a Vendor that cannot be resolved directly, you can raise it through POKISTOCK’s support tools. We may review evidence from both parties and help facilitate a resolution, though (except as described in Section 4) the Vendor remains responsible for the outcome.

11. Data protection

Your personal data is handled in accordance with our Privacy Policy, available at pokistockapp.com/legal/privacy-policy.

12. Changes to these terms

We may update these Terms from time to time. Continuing to use POKISTOCK after a change takes effect means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of England and Wales, and any disputes are subject to the jurisdiction of the courts of England and Wales.
